You acknowledge and agree that the Site contains proprietary information that is protected under Australian intellectual property laws, including the laws of copyright and trademark. Except as expressly authorized by us or our licensors, you agree not to sell, rewrite, modify, redistribute, create derivative works from the Site content in whole or in part.
You must look at the Site online, download individual pages to your personal or handheld computer for later reading, and even print a copy of pages for yourself. You must not remove any copyright notices from our materials. We reserve all of our other rights not granted in these Terms of Use. Promotional Codes
Promotional Codes are only applicable to the cost of products and are not applicable on shipping costs unless explicitly specified. Promotional codes are valid for customers of www.jimmyhalfpenny.com.au. Promotional codes cannot be combined with other promotions or promotional codes unless stated. Jimmy Halfpenny reserves the right to verify the validity of the promotional discount code and may at its sole discretion cancel orders or refuse to fulfil orders where the discount code has been used by a non-qualifying customer. Your purchase and delivery are subject to Jimmy Halfpenny’s standard Terms & Conditions. Additional conditions of use may apply and will be communicated by Jimmy Halfpenny.
User Ideas/Submissions
Should you provide any ideas for product development and/or enhancement to be used by the Site, those ideas automatically become our property and you automatically forfeit your right to any ownership of these ideas, including without limitation any intellectual property in and to these ideas. If you intend to own the intellectual property rights in these ideas please do not submit your concepts or prototype samples to us.
Prohibited Use of Site
You must not use the Site to violate any law, statute, ordinance or regulation;
submit, transmit or otherwise make available any material or content that is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, pornographic, libelous, invasive of another’s privacy, hateful, offensive, or racially, ethnically or otherwise objectionable. Only those creations which are clearly the work of a child will be accepted for incorporation into a child’s book. Adult content must not be the subject matter of any piece of art and any threatening, defamatory, abusive, obscene, pornographic, inappropriate or profane material or any other material that could give rise to any civil or criminal liability under applicable law will be not be accepted; harm minors in any way; impersonate any person or entity or falsely state or misrepresent your identity or affiliation with another person or entity; manipulate headers or identifiers to disguise the origin of any material or content submitted or transmitted to Us; submit, transmit or otherwise make available any material or content that you do not have the right to make available under any law or contractual or fiduciary relationship; submit, transmit or otherwise make available any material or content that infringes any patent, trademark, trade secret, copyright or other proprietary rights of any party;
interfere with or disrupt the Site, servers or network; submit, transmit or otherwise make available material or content that contains viruses, worms, corrupt files, Trojan horses and other forms of corruptive code intentionally or unintentionally violate any applicable local, state, national or international law, including any regulations having the force of law;
harvest or collect information about or from other members without their express consent and, if such consent is provided, only pursuant to applicable law.
We have the sole discretion to determine whether material or content provided by you constitutes prohibited material or content, and any material or content submitted to us may be examined and rejected at any time. You acknowledge that although we do not and will not examine and review all material and content submitted or transmitted to us, we have the absolute right (but not the obligation) to review, delete, move, and edit such material and content, or take any other appropriate action with respect to prohibited content and material, for any reason, at any time, without notice. Notwithstanding the above, when you access the Site, you acknowledge and agree that all material or content (whether private or public) that is provided to us and/or uploaded and/or stored on the Site is the sole responsibility of the person who submitted it. You understand that by viewing the Site, you may be exposed to material or content that you consider offensive and you take sole responsibility for such exposure.
Acceptance Procedure
By accessing the Site or registering, you agree with all the terms and conditions of these Terms of Use. We reserve the right, in our sole discretion, to change these Terms of Use from time to time, and your continuing use of the Site constitutes your acceptance of and agreement to any changed terms and conditions.
Payment Terms
Once an order has been placed you have a period of 12 months to return your artwork to Jimmy Halfpenny from the date of purchase. It is your responsibility to ensure that your artwork has been sent to Jimmy Halfpenny within this 12 month timeframe.
After this period expires your order will no longer be valid and no refund will be issued. All payments will be processed through an online payment system (“Payment System”) – PayPal or Afterpay Pty. Ltd. The Site is not responsible, nor liable for the monetary transactions done via this Payment System. In addition, you are subject to transaction fees from the Payment System and its terms of service regarding this fee. Refunds for users and/or customers are not the responsibility of the Site.

Starter Kits
Your Starter Kit will be with you within 10 business days. It includes all the information you need to prepare & sort your artwork/cards/keepsakes for it's onward journey, along with a prepaid satchel to make the process super simple! Should your kit not arrive within this timeframe, we ask that you inform us within 14 days of the date of order to enable us to issue another kit. Should you not inform us in this timeframe - no additional kit will be issued and it will be your responsibility to return your artwork to us at your own cost. No additional satchels will be provided should you lose or misplace your satchel once it arrives.
Refunds and Returns Policy
We cannot offer returns or refunds as our products are made to order. In placing an order you are giving your permission for our Design Team to showcase your child’s art, using their professional judgement and expertise to design the book with regards to layout, backgrounds, colour choices, fonts, image size and formatting. Should you wish to have an electronic proof of your completed book sent to you via email prior to it going to print, you can choose this option for an additional fee on the payment page of our website. Please note that any changes to layout that you request following receipt of this proof, will be charged at a rate of $7.00 per layout change – layout changes may include a single page layout, a background colour, or the size of a particular image. We cannot completely redesign the layout of a book after the proof is sent. If you would like a more extensive redesign, please email us directly. It is the responsibility of the customer to notify Jimmy Halfpenny of final approval of the book within 7 days of receipt of the electronic proof. Should approval not be granted via email or phone within this timeframe, the book will go into final production regardless and will be deemed as having been approved.
Jimmy Halfpenny will replace faulty products only if it is evident that they were damaged before arriving at your doorstep.
We will take every possible precaution to return the original artwork to you in the condition it was received, but we cannot take responsibility for any damage received in transit.
Jimmy Halfpenny prides itself on the quality of the Goods which it produces and conducts quality assurance checks on all Goods. In the event that you discover a manufacturing error, for example the physical condition of Goods, you should inform us immediately in accordance with the following process:
(a) as soon as possible, but not more than 7 days, after the Order is delivered to you, you must contact Jimmy Halfpenny at the e-mail address listed on the Website and provide a description and photographic evidence of the manufacturing error or cause of dissatisfaction. You must also provide photographic evidence of the condition of the packaging to enable Jimmy Halfpenny to determine if the Goods were damaged during delivery to you;
(b) Jimmy Halfpenny will review the description and photographic evidence provided by you and will determine, in its absolute discretion, whether to replace the Goods, repair the Goods or provide you with an explanation as to why Jimmy Halfpenny has declined to repair or replace the Goods. Jimmy Halfpenny will inform you of its decision within 7 days of receiving your e-mail. This provision will always be determined in accordance with Australian Consumer Protection Law.
Artwork Returns
At point of sale you are given the opportunity to pay for your artwork to be returned. If you do not select for your artwork to be returned you are giving Jimmy Halfpenny permission to dispose of all received artwork within 7 days of dispatch of your finalised product(s). Jimmy Halfpenny cannot be held liable for any change of mind.
All original artwork returned by Jimmy Halfpenny is done so at the customer's own risk. Should artwork go missing in transit, Jimmy Halfpenny will not be held responsible for the loss/damage of the artwork, nor will any compensation for the loss or damage of original artwork be provided.
Tracking your parcel
When customer products have been dispatched, the customer will be notified via email that they have been sent. The email will also contain the name of the carrier and a tracking number to enable the customer to track the delivery. In the event that the customer is not present to receive the parcel at the nominated delivery address it is the responsibility of the customer to follow up with the carrier to arrange re-delivery or collection.
